DATENSCHUTZ IM NOTARBÜRO

Die Vertraulichkeit und der Schutz der Privatsphäre der Mandanten haben im Notariat einen besonders hohen Stel-lenwert. Wir möchten Sie im Folgenden darüber in Kenntnis setzen, welche personenbezogenen Daten wir nach der EU-Datenschutz-Grundverordnung (DSGVO) verarbeiten. Der Information können Sie auch entnehmen, welche Rechte Sie bezüglich Ihrer Daten haben.

1. VERANTWORTLICHKEIT FÜR DIE DATENVERARBEITUNG

Verantwortliche im Sinne der DSGVO für die Verarbeitung der personenbezogenen Daten sind:

2. ZWECK DER DATENVERARBEITUNG

Wir verarbeiten bei der Wahrnehmung der uns gesetzlich übertragenen Aufgaben personenbezogene Daten. Diese Datenverarbeitung erfolgt auf Ihre Anfrage hin und ist für die angemessene Bearbeitung Ihres Anliegens sowie zur Erfüllung von Informations- und Antragspflichten erforderlich.

3. KATEGORIEN PERSONENBEZOGENER DATEN UND RECHTSGRUNDLAGEN FÜR DEREN VERARBEITUNG

Personenbezogene Daten, die von uns verarbeitet werden, sind alle Daten, die auf Sie persönlich beziehbar sind. Dazu zählen unter anderem:
 

  • allgemeine Personendaten: Name, Geburtsdatum und Alter, Geschlecht, Geburtsort, Familienstand, Anschrift, Staatsangehörigkeit, E-Mail-Adresse, Telefonnummer etc.;
  • Kennnummern: Personalausweis- und Passnummer, Steueridentifikationsnummer, Führerschein, Kfz-Kennzeichen etc.;
  • Bankdaten: Kreditinstitut, Bankverbindung, Kreditinformationen etc.;
  • Vermögensverhältnisse: Immobilieneigentum, sonstige Rechte an Grundstücken, Gesellschaftsbeteiligungen,  Versicherungen, Einkommen, Renteninformationen, sonstiges bewegliches Vermögen etc.


Für die Verarbeitung personenbezogener Daten ist die Rechtsgrundlage Art. 6 Abs. 1 lit. c) und e) DSGVO, § 3 Abs. 1 SächsDSDG i.V.m. dem notariellen Berufsrecht (insbesondere BNotO, BeurkG und DONot).

Art. 6 Abs. 1 lit. c) DSGVO erlaubt die Datenverarbeitung, wenn diese zur Erfüllung rechtlicher Verpflichtungen des Verantwortlichen erforderlich ist. Art. 6 Abs. 1 lit. e) DSGVO gestattet die Datenverarbeitung zur Wahrnehmung einer Aufgabe im öffentlichen Interesse und die Verarbeitung in Ausübung öffentlicher Gewalt.

Darüber hinaus können für ein ordnungsgemäßes Verfahren nach dem BeurkG besondere Kategorien von perso-nenbezogenen Daten verarbeitet werden, z.B. Angaben zu Behinderungen (Seh-, Hör-, Schreibbehinderungen), sexueller Orientierung und Gesundheitsdaten. Rechtsgrundlage für die Verarbeitung dieser besonderen Kategorien von Daten ist Art. 9 Abs. 2 lit. g) DSGVO, § 22 Abs. 1 Nr. 2 lit. a) i.V.m. §§ 11, 17, 22 ff., 28 BeurkG.

Weiterhin erheben wir auch bei öffentlich zugänglichen Quellen personenbezogene Daten, z.B. Grundstücksdaten vom Grundbuchamt und Registerdaten vom Handelsregister. Ferner erheben wir Daten aus sonstigen Quellen z.B. bei Gläubigern. Dies geschieht jedoch nur auf Grund vorheriger Veranlassung durch Sie und zur Bearbeitung Ihres konkreten Anliegens bzw. zur Erfüllung von gesetzlichen Pflichten.
 
4. EMPFÄNGER IHRER DATEN

Wir übermitteln Ihre personenbezogenen Daten nur dann an Dritte, wenn dies gesetzlich erlaubt und erforderlich ist oder Sie hierin eingewilligt haben.

Empfänger Ihrer personenbezogenen Daten können vor allem sein: das Grundbuchamt, das Handelsregister, das Zentrale Testamentsregister, das Zentrale Vorsorgeregister, das Finanzamt, die Ländernotarkasse, andere Notare, Kreditinstitute und sonstige private Dritte. Die Übermittlung an private Dritte geschieht nur zur Erfüllung Ihres konkreten Anliegens und nur auf Ihre Veranlassung.

Weiterhin erfolgt die Übermittlung von Daten an weitere berechtigte Empfänger. Dazu gehören insbesondere von uns eingesetzte Dienstleister, wenn diese als Auftragsverarbeiter nach Art. 28 DSGVO beauftragt werden. Auftragsverarbeiter in diesem Sinne sind z.B. der IT-Systembetreuer, die Notarsoftwareanbieter, die Finanzbuchhaltung.

5. SPEICHERUNG IHRER DATEN

Wir bewahren Ihre Daten entsprechend den gesetzlichen Aufbewahrungsfristen auf. Die Aufbewahrungsfristen richten sich primär nach der DONot sowie der AO und sind von dem Verarbeitungszweck abhängig. So beträgt z.B. die Aufbewahrungsfrist für Buchungsbelege zehn Jahre ab Empfang bzw. Versand der Korrespondenz und Erfassung in der Finanzbuchhaltung, (§ 257 HGB i.V.m. § 147 AO) oder 100 Jahre bei einem Vermerk über Verfügungen von Todes wegen gemäß § 20 Abs. 1 DONot.

6. IHRE RECHTE

Sie haben gegenüber uns folgende Rechte hinsichtlich der Sie betreffenden personenbezogenen Daten:

    - Auskunft über Sie betreffende personenbezogene Daten (Art. 15 DSGVO);
    - Berichtigung Sie betreffende unrichtige personenbezogene Daten (Art. 16 DSGVO);
    - Löschung personenbezogener Daten (Art. 17 DSGVO);
    - Einschränkung der Verarbeitung personenbezogener Daten (Art. 18 DSGVO);
    - Widerspruch gegen die Verarbeitung personenbezogener Daten (Art. 21 DSGVO).

Die vorstehenden Rechte gelten nur insoweit, als das diesen nicht die notarielle Verschwiegenheitsverpflichtung gemäß § 18 BNotO entgegensteht. Die Verarbeitung Ihrer Daten erfolgt auf der Basis von gesetzlichen Regelungen.

Nur in Ausnahmefällen benötigen wir Ihre Einwilligung. In diesen Fällen haben Sie zusätzlich das Recht, die Einwil-ligung für die zukünftige Verarbeitung zu widerrufen (Art. 7 Abs. 3 DSGVO). Die bisherige Rechtmäßigkeit der Verarbeitung wird durch diesen Widerruf nicht berührt.

Sie haben ferner das Recht, sich an eine Aufsichtsbehörde für den Datenschutz zu wenden, wenn Sie der Ansicht sind, dass die Verarbeitung Ihrer personenbezogenen Daten nicht rechtmäßig erfolgt.

The confidentiality and protection of the client's privacy have a particularly high value in the notary's office. We (the responsible party) would like to inform you in the following which personal data we process according to the EU data protection basic regulation (DSGVO). The information also tells you what rights you have with regard to your data.

1. RESPONSIBILITY FOR DATA PROCESSING

2. PURPOSE OF DATA PROCESSING
We process personal data in the performance of the tasks assigned to us by law. This data processing takes place at your request and is necessary for the appropriate processing of your request and for the fulfilment of information and application obligations.

3. CATEGORIES OF PERSONAL DATA AND LEGAL BASES FOR THEIR PROCESSING
Personal data processed by us are all data that are personally identifiable to you. These include, among other things:

  • general personal data: Name, date of birth and age, gender, place of birth, marital status, address, nationality, e-mail address, telephone number etc.;
  • Identification numbers: Identity card and passport number, tax identification number, driving license, vehicle registration number, etc.;
  • Bank details: Credit institution, bank details, credit information, etc.;
  • Financial circumstances: Real estate property, other rights to land, shareholdings, insurance, income, pension information, other movable assets, etc.

The legal basis for the processing of personal data is Art. 6 para. 1 lit. c) and e) DSGVO, § 3 para. 1 SächsDSDG in conjunction with DONot.

Art. 6 para. 1 lit. c) DSGVO permits data processing if this is necessary for the fulfilment of legal obligations of the person responsible. Art. 6 para. 1 lit. e) DSGVO permits data processing for the performance of a task in the public interest and processing in the exercise of official authority.
In addition, special categories of personal data, e.g. information on disabilities (visual, hearing and writing disabilities), sexual orientation and health data, may be processed in accordance with the BeurkG for a proper procedure. The legal basis for the processing of these special categories of data is Art. 9 Para. 2 g) DSGVO in conjunction with Articles 11, 17, 22 et seq., 28 BeurkG.

Furthermore, we also collect personal data from publicly accessible sources, e.g. property data from the land registry and register data from the commercial register. Furthermore, we collect data from other sources, e.g. creditors. However, this is only done on the basis of your prior request and in order to process your specific request or to fulfil legal obligations.

4. RECIPIENTS OF YOUR DATA
We will only transfer your personal data to third parties if this is legally permitted and necessary or if you have consented to this.
The recipients of your personal data can be: the land registry, the commercial register, the central register of wills, the central register of pension provision, the tax office, the state notary, other notaries, credit institutions and other private third parties. The transfer to private third parties is only for the fulfilment of your specific request and only at your request.
Furthermore, data is transmitted to other authorized recipients. This includes in particular service providers employed by us if they are commissioned as contract processors in accordance with Art. 28 DSGVO. Order processors in this sense are e.g. the IT system administrator, notary software providers, financial accounting.

5. STORAGE OF YOUR DATA
We store your data in accordance with the legal retention periods. The retention periods are primarily based on DONot and AO and depend on the purpose of processing. For example, the retention period for booking documents is ten years from receipt or dispatch of correspondence and entry in financial accounting (§ 257 HGB in conjunction with § 147 AO) or 100 years in the case of a note on disposals of death in accordance with § 20 (1) DONot.

6. YOUR RIGHTS
You have the following rights towards us with regard to personal data concerning you:

  • Information about personal data concerning you (Art. 15 DSGVO);
  • Correction of inaccurate personal data concerning you (Art. 16 DSGVO);
  • Deletion of personal data (Art. 17 DSGVO);
  • Restriction of the processing of personal data (Art. 18 DSGVO);
  • Objection to the processing of personal data (Art. 21 DSGVO).

The above rights only apply insofar as they do not conflict with the obligation of notarial confidentiality pursuant to § 18 BNotO. Your data will be processed on the basis of legal regulations. We only require your consent in exceptional cases. In these cases, you also have the right to revoke the objection for future processing (Art. 7 para. 3 DSGVO). The previous legality of the processing is not affected by this revocation.
You also have the right to contact the competent supervisory authority for data protection if you believe that the processing of your personal data is not lawful.
